THE RELEVANCE OF TAKLIK TALAK IN THE CONTEXT OF MODERN FAMILY AND MARRIAGE

Abstract

Family and marriage are two important institutions in society that have experienced significant transformation along with the times and social changes that have occurred. Nowadays, an interesting phenomenon has emerged, namely taklik talak in the context of family and marriage. This phenomenon raises questions about the relevance of divorce in today's family and marriage life considering that the settlement procedure is the same as divorce. This research uses normative research which analyzes based on statutory regulations. Taklik talak, as a practice that regulates divorce in Islamic society, is an interesting topic to research in the context of today's families and marriages. In an era where gender roles and power dynamics in husband and wife relationships are often in the spotlight, it is important to reveal how taklik talak can influence modern family dynamics. The results of this research show that divorce taklik is no longer relevant, but premarital and postmarital education is more appropriate as a preventive measure to avoid something undesirable. Thus, it is hoped that this research can provide a deeper understanding of how the divorce agreement applies to family and marriage dynamics today.
