Nyongkolan Culture in Sasak Tribe Marriage: A Fiqh Analysis Based on al-ʿĀdah Muhakkamah

Abstract

This study aims to analyse the Nyongkolan culture of the Sasak tribe on the island of Lombok from the perspective of qoidah al ādah muhakkamah. Nyongkolan is a culture related to the marriage process on the island of Lombok. In this culture, it is undeniable that there is something that contradicts the Sharia, so it is necessary to study more deeply how the law of this culture is actually under the Qidah fiqih approach above, and solutions are given so that it is in accordance with Islamic law. The method used in this research is qualitative, with a library research data collection approach. The method shows several conclusions, including that Nyongkolan culture is a positive culture, because in it, there is a strong culture of mutual cooperation and cohesiveness between the extended families of the bride and groom. Although this is a culture, it is not denied that there is a clear postulate or legal basis; it's just that there are some aspects that are not appropriate when implementing the culture. But in general, this culture has its arguments, so that the qoidah al ādah muhakkamah is a reinforcement of its permissibility. Previous studies mostly focused on social aspects and paid little attention to legal analysis. Therefore, this research emphasizes the determination of Islamic law related to cultural practice. It is expected that this study will raise public awareness of the importance of maintaining Sharī‘ah principles when practicing local traditions.
